I have the honour to confirm my telegram of the
29th. April which decoded was as follows:- "With reference to my
Confidential Despatch of the 19th. Miarch person named applying for
fresh writ of Habeas Corpus, despatch follows by mail*.

Chung Sau Nam's representatives are now, I
understand, on the ground that an alleged recent proclamation of General Lung, the Governor-General of Kwangtung has materially strengthened the case in favour of the accused, moving for a fresh writ of Habeas Corpus, and the motion has been adjourned in order to give them an opportunity of obtaining evidence of the alleged proclamation, the translation of which extracted from the "Hongkong Daily Press" of the 26th. March is attached.

I have been unable to ascertain whether the application to be made to the Privy Council referred to in para- 13373 graph 2 of my Confidential Despatch has yet been filed with the
Registrar of the Council. It is not, however, unlikely that the prosecution of this appeal will be stayed pending the result of the further proceedings under Habeas Corpus.
